Scrub Service Terms
Effective date: September 28, 2026
Version: 2026-09-28
PLEASE READ. SECTION 14 REQUIRES YOU TO RESOLVE DISPUTES WITH US IN INDIVIDUAL ARBITRATION, AND YOU GIVE UP ANY RIGHT TO A JURY TRIAL OR TO BRING OR JOIN A CLASS ACTION. SECTIONS 11 AND 12 DISCLAIM WARRANTIES AND LIMIT OUR LIABILITY. SECTION 13 MAKES YOU RESPONSIBLE FOR CLAIMS ARISING FROM YOUR CALLS AND TEXTS.
These Scrub Service Terms are an agreement between Capital Commission Management, LLC, a Texas limited liability company doing business as theFurnace.ai ("theFurnace," "we," "us"), and the person or business that buys credits for or uses the DNC + Litigator Scrub at dnc.thefurnace.ai (the "Scrub Service") ("you"). If you accept for a business, you confirm you have authority to bind it, and "you" means the business and you.
These are Product Terms under our Terms of Service at join.thefurnace.ai/terms (the "Master Terms") and are part of them. Our Privacy Policy and the Scrub Privacy Addendum at dnc.thefurnace.ai/privacy also apply. If these Scrub Service Terms conflict with the Master Terms, these control for the Scrub Service. Parts of the Master Terms that describe CHLOE, messaging, leads we arrange, or appointments do not apply to the Scrub Service.
How you agree. You agree to these Scrub Service Terms when you place an order for credits, create an account, sign in, or upload a file, whichever comes first. Each of those screens tells you that doing so means you agree and links to these terms. IF YOU DO NOT AGREE, DO NOT BUY CREDITS OR USE THE SCRUB SERVICE.
1. What the Scrub Service is
The Scrub Service is a data lookup tool for businesses. You upload a file of leads. We send the phone numbers in it (and, where your file has names, the names) to third-party data providers, which check them against the lists they maintain or license, such as the National Do Not Call Registry, state do-not-call registries they cover, lists of known do-not-call complainers, and lists of known TCPA litigators. They also return a line type for each number (for example mobile, landline, or invalid). We pass their answers back to you as a cleaned file, a file of removed rows with reasons, and a report.
We are a middleman. We do not create, own, maintain, audit, or verify any registry, list, or data our providers return. We scrub as well as we know how, using what our providers give us, and nothing more.
The Scrub Service does not call, text, or contact anyone. It does not sell or supply leads. It does not advise you on what to do with any number.
The Scrub Service is for business use only. It is not offered to consumers. By using it, you represent that you are at least 18 years old and are using it only for business purposes, not for personal, family, or household use.
We are not a consumer reporting agency, and no result is a consumer report under the Fair Credit Reporting Act.
2. What the Scrub Service does not do
The Scrub Service does NOT:
- check whether you have consent to call or text anyone, or what kind of consent the law requires for your outreach;
- check calling or texting hours, time zones, call frequency limits, or state telemarketing registration, bonding, or licensing rules;
- check your own internal do-not-call list, or any opt-out or revocation made directly to you or anyone working for you;
- check whether a number was reassigned to a new person;
- check any state do-not-call registry our providers do not cover;
- find every person who has sued or may sue. A litigator or complainer list includes only people our providers have identified. Anyone who has not sued before, or whose filings our providers have not recorded, will not be flagged;
- guarantee that any name match is correct. Name matching can miss a match or match the wrong person;
- give you a National Do Not Call Registry subscription. If the law requires you to hold your own registry account, getting and keeping it is up to you;
- make any list "safe," "clean," or "compliant" in a legal sense.
3. Results are a snapshot
Each result reflects our providers' data as of their last update before your scrub. Providers update on their own schedules. A number added to a registry or list after that update will not be flagged, and a number flagged today may not be flagged tomorrow. Line type data can be wrong or change, for example when a number is ported. You are responsible for re-scrubbing as often as the law and your business require, and for reviewing every result before you rely on it.
4. No guarantee. Not legal advice. No safe harbor.
THE SCRUB SERVICE DOES NOT GUARANTEE THAT YOU WILL NOT BE SUED, FINED, INVESTIGATED, OR COMPLAINED ABOUT, AND IT DOES NOT MAKE ANY CALL, TEXT, OR LIST COMPLIANT WITH THE TELEPHONE CONSUMER PROTECTION ACT, THE TELEMARKETING SALES RULE, OR ANY STATE OR LOCAL LAW. USING THE SCRUB SERVICE IS NOT A SAFE HARBOR AND DOES NOT CREATE ONE.
The Scrub Service is a convenience tool. It may be incomplete, wrong, or unavailable. It is not legal advice, not a compliance review, and not a certification of anything. It does not shift any compliance responsibility from you to us or to our providers. Talk to your own lawyer about your outreach.
Our marketing is not a promise. Statements on our websites, emails, ads, and buttons about lawsuits, risk, protection, or results (including words like "protect," "avoided," or "clean," counts of numbers we have flagged, and references to court cases or settlements) describe what the Scrub Service checks and why businesses use it. They are not promises of any outcome and are not part of this agreement. You confirm you are not relying on any statement that is not written in these Scrub Service Terms.
5. You are solely responsible for your outreach
You alone are responsible for every call, text, email, voicemail, and other contact that you or anyone working with you or for you makes to any person, whether or not the number was scrubbed, whether the scrub result was right or wrong, and whether or not you followed it. That includes consent, calling and texting hours, internal do-not-call lists, opt-outs, registry subscriptions, disclosures, and every other requirement of federal, state, and local law. You decide what to do with every result.
6. Your data and your promises about it
You promise that:
- you have the legal right to hold, use, and upload every file you submit, and to have us and our providers process it as these terms describe;
- your files were collected and are used in compliance with the law, and uploading them does not break any agreement you are bound by;
- you will not upload Social Security numbers, bank account or payment card numbers, health or medical information, driver's license or other government ID numbers, passwords, or information about children. Remove those columns before you upload. If we find them, we may delete the file without notice and without returning credits;
- everything you tell us about yourself and your business is true.
7. Acceptable use
You may use the Scrub Service only for your own business's lists, and only to decide which numbers not to contact or how to contact them. If you run an agency or team, your business includes the agents who work under you (for example, your downline), and you may scrub lists for them. When you do, you confirm you have their permission, you make sure they follow these terms, and you are responsible for their use of the results as if it were your own, including under Section 13. You may not:
- use the Scrub Service or any result to decide anyone's eligibility for credit, insurance, employment, housing, or any other purpose covered by the Fair Credit Reporting Act, or treat any result as a consumer report;
- use any result to find, target, contact, harass, publish, expose, or retaliate against any person flagged as a litigator or complainer;
- copy, compile, sell, license, or share the flags or any provider data, or use the Scrub Service or its results to build a do-not-call, litigator, complainer, or suppression list, database, or product for anyone else;
- resell the Scrub Service, run scrubs for other businesses (other than agents working under you, as allowed above), or offer its results as a service, unless we agree in writing;
- share your account or sign-in with anyone outside your business;
- probe, scrape, overload, reverse engineer, or try to get around limits, security, or billing in the Scrub Service, or try to reach our providers' data other than through normal use;
- upload any file containing malicious code;
- use the Scrub Service in any way that breaks the law or these terms.
We may refuse, pause, or stop any scrub, file, or account that we believe breaks these rules, breaks the law, or creates legal, provider, or reputational risk for us, in our sole discretion and without liability. Credits used on a scrub we stop under this section are not returned.
8. Credits and payment
- What a credit is. The Scrub Service runs on prepaid credits bought at checkout. One credit scrubs one unique phone number in a file you submit. Credits are charged when a scrub is submitted, whether each number comes back clean or flagged. The price is the one shown at checkout. Credits are a prepaid right to use the Scrub Service. They are not money, a deposit, a stored-value account, or property.
- Credits do not expire while your account is open. There is no expiration date on credits. Credits end only as Section 9 describes (account closed, account terminated, or the Scrub Service discontinued).
- ALL SALES ARE FINAL. Credit purchases are non-refundable, in whole or in part, for any reason, including unused credits, results you did not like, a closed or terminated account, or the Scrub Service being discontinued. The only exceptions are the failed-scrub rule below and any refund the law requires.
- Failed scrubs. If a scrub does not finish because the submission to our data providers fails or our providers report the job as failed, the credits charged for it go back to your credit balance automatically. If a scrub fails for another reason on our side, we will either finish it or put the credits back on your balance, at our choice. Failed-scrub returns are credits, never cash.
- Bonus and promotional credits. Bonus credits (for example a first-purchase match) are a free extra. They have no cash value, cannot be refunded or transferred, and are subject to the conditions in the offer. A first-purchase offer is limited to one per person and business. We may remove bonus credits obtained by breaking an offer's conditions, including by opening more than one account. Paid and bonus credits are used from one balance with no set order.
- When credits appear. Purchased credits are added to your account after your payment clears. Any time we give for this is an estimate, not a guarantee.
- No transfer. Credits cannot be sold, transferred, moved to another account, or exchanged for cash.
- Taxes. Prices do not include taxes. Any tax on your purchase is yours.
- Chargebacks. Section 9 of the Master Terms ("Talk to us before your bank") applies. If you dispute a credit purchase, we may remove those credits (and any bonus credits tied to that purchase) from your balance and suspend your account until the dispute is resolved. Our records of uploads, scrubs, credits, and downloads are evidence of delivery.
9. Suspension, termination, and discontinuation
- By you. You may stop using the Scrub Service at any time, and may ask us to close your account by emailing scrub@thefurnace.ai from your account email. Unused credits end when your account closes.
- By us, for cause. We may suspend or terminate your account immediately, without notice or liability, if we believe you broke these terms or the Master Terms, disputed a payment, gave us false information, or created legal, provider, or reputational risk for us. Unused credits (paid and bonus) are forfeited.
- By us, for any other reason. We may terminate any account at any time for any reason or no reason. If we do this without cause, we will first give you 30 days' notice by email, and you may use your remaining credits during that time. Credits not used by the end of the notice period are forfeited.
- Discontinuation. We may change, limit, or stop offering the Scrub Service, in whole or in part, at any time. If we stop offering it entirely, we will give you at least 30 days' notice by email and you may use your remaining credits during that time. Credits not used by the end of the notice period are forfeited. No refund is due.
- Your files after termination. When an account is closed or terminated, we may delete its files and results (see Section 10). Download anything you want to keep first.
- Survival. Sections 4 through 7 and 10 through 17 survive termination.
10. Your files: our role, retention, and deletion
- Our role. Your files and results are yours. We process them on your behalf, as your service provider, to run your scrubs, deliver your results, support you, prevent abuse, and keep business records. We send phone numbers, and names where your file has them, to our third-party data providers to run the checks. We do not sell your files, use them to market to the people in them, or share them with other customers. We may use counts that do not identify you or any person (for example, total numbers flagged across all scrubs) to describe and improve the Scrub Service. You authorize all of this.
- Third-party data providers. Our providers handle what we send them under their own terms and policies. We do not control, and make no promise about, how they store, use, or delete it.
- Retention. Our practice is to keep your uploaded files, results, and reports in your account with no set expiration while your account is open. We do not promise any file will stay available, and the Scrub Service is not a backup or storage service. Keep your own copies.
- Deletion. Email scrub@thefurnace.ai from your account email to delete any file, all of your scrub data, or your account. After we confirm the request came from you, we will delete the requested files and results from our active systems within 30 days. Copies may remain in backups until they are overwritten in the normal course. We keep records of payments, credit transactions, and the fact that a scrub ran (date, number count, credits used), plus anything the law requires or that we need for a dispute. Deletion does not reach data already sent to our providers.
- People in your files. If a person in a file you uploaded contacts us about their data, we may tell you and point them to you, and you will handle the request as the law requires. If you tell us to delete a person's data from our systems, we will.
- Security. We use reasonable safeguards, described in the Scrub Privacy Addendum. No system is perfectly secure. If a breach affects your files, we will notify you as the law requires.
11. DISCLAIMER OF WARRANTIES
THE SCRUB SERVICE, EVERY RESULT, AND ALL DATA FROM OUR PROVIDERS ARE PROVIDED "AS IS," "AS AVAILABLE," AND WITH ALL FAULTS. TO THE MAXIMUM EXTENT THE LAW ALLOWS, WE AND OUR PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT ANY RESULT IS ACCURATE, COMPLETE, OR CURRENT, THAT ANY PROVIDER COVERS ANY PARTICULAR STATE, LIST, NUMBER, OR PERSON, THAT ANY FLAGGED NUMBER IS RISKY OR ANY UNFLAGGED NUMBER IS SAFE, THAT USING THE SCRUB SERVICE WILL PREVENT ANY CLAIM, OR THAT THE SCRUB SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE MAKE NO WARRANTY ABOUT ANY THIRD PARTY, INCLUDING OUR DATA PROVIDERS, PAYMENT PROCESSOR, HOSTING, AND EMAIL PROVIDERS.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT THE LAW ALLOWS:
(a) SOLE REMEDY. IF A SCRUB RESULT IS WRONG OR THE SCRUB SERVICE FAILS, YOUR SOLE AND EXCLUSIVE REMEDY IS THAT WE WILL, AT OUR CHOICE, RE-RUN THE AFFECTED NUMBERS AT NO CHARGE OR RETURN THE CREDITS USED FOR THEM TO YOUR BALANCE.
(b) NO LIABILITY FOR YOUR OUTREACH. WE ARE NOT LIABLE FOR ANY CLAIM, DEMAND, LAWSUIT, ARBITRATION, INVESTIGATION, FINE, PENALTY, JUDGMENT, SETTLEMENT, OR DEFENSE COST ARISING FROM ANY CALL, TEXT, OR OTHER CONTACT MADE BY YOU OR ANYONE WORKING WITH OR FOR YOU, EVEN IF A SCRUB RESULT WAS WRONG, INCOMPLETE, OR LATE, AND EVEN IF THE CLAIM IS BASED ON OUR NEGLIGENCE.
(c) NO INDIRECT DAMAGES. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, LEADS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
(d) CAP. OUR TOTAL LIABILITY FOR ALL CLAIMS OF ANY KIND ARISING OUT OF OR RELATING TO THE SCRUB SERVICE OR THESE TERMS, COMBINED, IS LIMITED TO THE VALUE OF THE CREDITS CHARGED FOR THE SCRUB THE CLAIM IS ABOUT, AND WILL NEVER EXCEED $1,000. "VALUE OF THE CREDITS" MEANS THE NUMBER OF CREDITS CHARGED FOR THAT SCRUB TIMES THE PRICE PER CREDIT YOU PAID ON YOUR MOST RECENT PAID CREDIT PURCHASE BEFORE THAT SCRUB.
(e) These limits apply to every legal theory, including contract, warranty, negligence, strict liability, and statute. They are an agreed allocation of risk that is reflected in our prices; without them we would not offer the Scrub Service at these prices. They do not limit your payment obligations or your indemnity duties, and they do not apply where the law forbids them, including liability for our fraud or intentional misconduct.
(f) Entity only. The "Entity only, no personal recourse" paragraph of Section 14 of the Master Terms applies. Any claim may be brought only against Capital Commission Management, LLC.
13. You protect us (indemnification)
You will defend, indemnify, and hold harmless theFurnace, its members, managers, owners, officers, employees, contractors, and agents, and our data providers, from and against all claims, demands, lawsuits, arbitrations, investigations, fines, penalties, losses, judgments, settlements, and costs (including attorney fees and costs of defense) arising out of or relating to:
- any call, text, or other contact made by you or anyone working with or for you, including every TCPA, Telemarketing Sales Rule, do-not-call, and state telemarketing claim, whether or not the number was scrubbed;
- your files, how you got them, and your right to upload them;
- your use of the Scrub Service or any result;
- your breach of these terms or the Master Terms, or your violation of any law; or
- use of your account by anyone you let in.
This applies EVEN IF THE CLAIM ALLEGES THAT A SCRUB RESULT WAS WRONG OR THAT WE WERE NEGLIGENT. It does not apply to the extent a court or arbitrator finally decides the loss was caused by our gross negligence or intentional misconduct. We may choose our own counsel and control the defense of any matter, at your expense, and you will cooperate. You may not settle any matter that involves us without our written consent. Section 15 of the Master Terms also applies.
14. Disputes: individual arbitration, class and jury waiver
Sections 16 (Disputes: arbitration and class waiver) and 17 (Governing law, Florida) of the Master Terms apply to the Scrub Service, with these additions:
- Who decides. The arbitrator decides all questions about whether a dispute must be arbitrated, including the scope, validity, and enforceability of this arbitration agreement, except that a court decides any question about the class, collective, or representative action waiver.
- Costs. If you show that arbitration fees would be so high compared with a court case that they would stop you from bringing your claim, we will pay the part of the filing and arbitrator fees that goes beyond what a court filing would cost you, unless the arbitrator finds your claim frivolous.
- Federal Arbitration Act. This arbitration agreement involves interstate commerce and is governed by the Federal Arbitration Act.
- One-year limit. To the extent the law allows, any claim must be brought within one (1) year after it arose, or it is permanently barred.
- Changes do not reach old disputes. A change to this Section 14 or to Section 16 of the Master Terms does not apply to a dispute that arose, or of which either side gave notice, before the change took effect.
- If the class waiver fails. If the class, collective, or representative action waiver is found unenforceable for any claim, that claim must be decided in court in Hillsborough County, Florida, and not in arbitration, and the rest of this Section 14 still applies to all other claims.
15. Changes
We may change the Scrub Service, its data providers, what it checks, and prices for future purchases at any time. We may change these Scrub Service Terms by posting a new version at dnc.thefurnace.ai/terms with a new effective date. For material changes we will also notify you by email or in your account. A change applies from its effective date and only going forward: it does not undo credits already added to your account or apply to a dispute that arose before it. If you keep using the Scrub Service after a change takes effect, you accept it. If you do not accept it, stop using the Scrub Service and ask us to close your account.
16. Electronic agreement and notices
Placing an order, clicking pay, creating an account, signing in, or uploading a file counts as your signature. You agree to receive notices, records, and agreements electronically at the email on your account, and that electronic records satisfy any requirement for a writing or signature. We keep each version of these terms and the date you accepted it.
17. General
- Third-party beneficiaries. Our data providers are intended third-party beneficiaries of Sections 7, 11, 12, and 13 and may enforce them. No one else is.
- Order of documents. For the Scrub Service, these Scrub Service Terms control over the Master Terms, and the Master Terms control over anything on our websites or in marketing.
- Severability. If any part of these terms is unenforceable, it will be limited to the minimum extent needed and the rest stays in effect.
- Assignment. You may not assign this agreement without our written consent. We may assign it at any time.
- No waiver. Not enforcing a right is not a waiver of it.
- Contact. Capital Commission Management, LLC d/b/a theFurnace.ai, 1600 E 8th Ave, STE A200, Tampa, FL 33605. Email scrub@thefurnace.ai. Phone 813-358-8389.
